TERMS OF SERVICE

These Terms of Service apply to your use of the Retail Store AU website and to purchases made through our online store. By accessing the website or placing an order, you agree to these terms.

1. Store information

This online store is operated by Retail Store AU. In these terms, “we”, “us” and “our” refer to Retail Store AU.

2. Eligibility

You must be legally capable of entering into a contract to place an order through our store.

You must provide accurate, current and complete information when placing an order. You are responsible for ensuring that your delivery address, email address and contact details are correct.

3. Products and information

We aim to describe and display our products accurately. Product colours and appearance may vary slightly because of lighting, photography, packaging changes and device display settings.

Product packaging, labels or designs may change without notice where the product itself remains substantially the same.

We may correct errors in product descriptions, availability, pricing or other store information at any time.

4. Prices and payment

All prices are displayed in Australian dollars unless stated otherwise.

Shipping charges are shown separately at checkout.

Payment must be successfully authorised before an order is processed. Available payment methods are displayed at checkout.

We may cancel or decline an order where:

• payment cannot be verified;
• an item is unavailable;
• the order contains an obvious pricing or listing error;
• fraud or unauthorised activity is suspected;
• delivery cannot be made to the supplied address; or
• accepting the order would breach applicable law or these terms.

If payment has already been received for an order that we cancel, the relevant amount will be refunded.

5. Order acceptance

An order confirmation acknowledges that we have received your order. It does not guarantee that the order has been accepted or dispatched.

An order is accepted when we confirm dispatch or otherwise confirm that it is being fulfilled.

6. Order cancellations

Customers may request cancellation of an unfulfilled order within the cancellation period displayed in our store.

Cancellation cannot be guaranteed once an order has entered processing or has been dispatched.

After dispatch, the Return and Refund Policy applies.

7. Shipping and delivery

We currently deliver within Australia only.

Available shipping services, prices and estimated delivery periods are explained in our Shipping Policy and displayed at checkout.

Delivery dates are estimates rather than guarantees. Delays may occur because of carrier disruption, weather, public holidays, peak periods, incorrect addresses or circumstances outside our reasonable control.

8. Returns, refunds and consumer rights

Change-of-mind returns are governed by our Return and Refund Policy.

Nothing in these terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded, including rights under the Australian Consumer Law.

Where a product does not meet an applicable consumer guarantee, the customer may be entitled to an appropriate remedy such as a repair, replacement or refund.

9. Personal-use products

Opened, used or unsealed shampoos, colognes, grooming products and other hygiene-sensitive products might not be accepted for a change-of-mind return.

This restriction does not limit rights relating to faulty, damaged, incorrect or misdescribed products.

10. Website use

You must not:

• use the website for unlawful or fraudulent purposes;
• interfere with the website’s operation or security;
• introduce malicious code;
• attempt to gain unauthorised access to store systems;
• copy or commercially exploit website content without permission; or
• provide false information when placing an order.

We may restrict access to the website where misuse, fraud or unlawful activity is suspected.

11. Intellectual property

The Retail Store AU name, branding, website layout, written content and original graphics are owned by or licensed to Retail Store AU.

Manufacturer names, trademarks, product photographs and other third-party material remain the property of their respective owners.

Content may not be reproduced, modified, sold or commercially distributed without permission, except where permitted by law.

12. Third-party services

Our store may use third-party services, including Shopify, payment processors and delivery providers.

Those services may be subject to separate terms and policies. We are not responsible for third-party websites or services that are outside our reasonable control.

13. Liability

To the maximum extent permitted by law, Retail Store AU is not responsible for losses caused by:

• customer-supplied information that is incorrect or incomplete;
• unauthorised use of a customer’s account or payment method;
• carrier delays outside our reasonable control;
• website interruptions outside our reasonable control; or
• use of a product contrary to its instructions, warnings or intended purpose.

Nothing in this section limits liability or consumer rights where liability cannot legally be excluded.

14. Changes to these terms

We may update these Terms of Service when our store operations, services or legal obligations change.

The version published on this website applies from its stated effective date. Changes do not remove rights that already apply to completed purchases.

15. Governing law

These terms are governed by the laws of Queensland and the applicable laws of Australia.
